Beta Tester Agreement

1. Who This Applies To

This Beta Tester Agreement ("Agreement") is between you ("Beta Tester") and Sim Capital Ventures, the operator of Monifest ("we," "us," or "our"). It applies to anyone who accesses Monifest during its beta testing phase at mymonifest.com.

2. Beta Access Is Free

As a beta tester, you will have free access to Monifest for the duration of the beta testing period. This includes access to features that may later be part of a paid Pro tier.

Free beta access is limited to the beta period only. Once Monifest officially launches, beta testers will be transitioned to a paid plan or a free tier as determined at that time. We will provide advance notice before any changes to your access.

3. Confidentiality

The Monifest beta is not yet publicly launched. By participating, you agree to:

• Keep the product, its features, design, and functionality confidential
• Not share screenshots, recordings, or descriptions of the app publicly without our written permission
• Not discuss unreleased features on social media, forums, or with the press
• Not disclose any non-public information about Sim Capital Ventures or its products

4. Feedback

We ask that beta testers provide honest feedback to help improve the product. By submitting feedback, you grant Sim Capital Ventures a perpetual, royalty-free license to use that feedback to improve Monifest. You retain no ownership over implemented suggestions.

5. Proprietary Name & Brand Protection

• You will not use, register, or attempt to register "Monifest" or any confusingly similar name as a business name, trademark, domain, or product name
• You will not copy, imitate, or replicate the Monifest brand, visual identity, or product concept
• You will not build, distribute, or commercialize any product that substantially replicates Monifest's features or design
• Any unauthorized use of the Monifest name or brand may result in legal action

Sim Capital Ventures has been using the Monifest name in commerce since 2025 and reserves all rights to pursue trademark registration and enforcement.

6. No Reverse Engineering

You agree not to reverse engineer, decompile, copy, or otherwise attempt to extract the source code, design patterns, or proprietary logic of Monifest. The app is provided as a service for personal finance tracking only.

7. Beta Nature of the Product

Monifest is currently in beta. This means:

• The product may contain bugs or errors
• Features may change, be added, or be removed without notice
• Data may occasionally be reset during major updates (we will provide notice when possible)
• Uptime is not guaranteed during the beta period

We are not liable for any losses — financial or otherwise — resulting from bugs, downtime, or data loss during the beta period. Always maintain your own records.

8. Your Data

Your use of Monifest during beta is also governed by our Privacy Policy. We collect only your first name, email, and the financial data you manually enter. We never sell your data.

9. Termination

We reserve the right to revoke beta access at any time for any reason, including violation of this Agreement. You may stop using Monifest at any time by requesting account deletion at support@mymonifest.com.

10. Governing Law

This Agreement is governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes will be resolved in Massachusetts courts.
